FSA Outlines How to Make EU’s AIFM Directive More Workable For Hedge Funds by Jennilyn Dicce
Sally Dewar, managing director of the FSA's wholesale division of markets, gave a speech on September 17, 2009 outlining four key areas that must be addressed to ensure effective regulation of funds and the regulatory approach should be adopted.
Speaking at the FSA assets Sector Management Conference, Dewar said: "Most of us can see the value of European capital markets and global economy in general and in the harmonization of reasonable and proportionate rules governing the areas under discussion. "
Dewar The four areas of note are:
- Correct identification of weaknesses in the current regulatory mechanisms and addressing them in a proportionate
- Differentiation between types of alternative investment fund management
- Adopting a risk based approach - the scope and thresholds of the Directive need to strike the right balance between imposing additional costs and allows regulators to identify and mitigate systemic risks
- The need for a comprehensive approach that recognizes the global nature of the sector and does not impose unjustifiable restrictions on geographic business models of companies that were able to restrict the choice of investors
